01
Who we are, and agreeing to these terms
This site, ticktechtoe.in, is run by Tick Tech Toe (“we”, “us”), in India. By using the site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.
These terms apply only to your use of this website. Any work we do for you is covered by a separate written contract. That contract prevails over these terms if the two conflict, and nothing on this site forms part of it unless the contract says so.
02
What the site is
The site describes our company and how we work. It is for general information, is not an offer capable of acceptance, and is not professional, legal, financial or tax advice. Examples, case studies, testimonials and past-work descriptions are illustrations, and results from past work are not a promise of results for you.
No client relationship exists between you and us until we both sign a written contract.
03
Using the site
You agree not to:
- use the site for anything unlawful, or to harm or deceive anyone
- probe, scan, overload or try to break into the site or its servers, or bypass its security
- submit the form by automated means, or send spam, malware or content you have no right to send
- send us another person’s personal information unless you have the right to
- scrape or copy the site in a way that burdens it, or pretend to be us or anyone else
04
Inquiries
Sending an inquiry does not create a contract. Please make sure what you send is accurate. By sending one you agree that we may reply to it and email you from time to time as the Privacy Policy describes.
Do not send confidential or sensitive material through the form: we handle it as set out in our Privacy Policy, but an inquiry is not covered by a confidentiality agreement unless we have signed one with you.
05
Intellectual property
The site’s content, design, text, graphics, logo and code belong to us or our licensors and are protected by law. The Tick Tech Toe name and logo are ours. You may view the site and share a link to it, and may quote short extracts with credit. Anything else, including copying, republishing, reselling or building on it, needs our written permission. Search engines and AI tools may read, cite and learn from the site, as our AI Disclosure sets out.
Other companies’ names and logos shown on the site belong to their owners. Work we do for clients is governed by the client contract, not by these terms. If you send us ideas or feedback, we may use them freely and owe you nothing for doing so; this does not apply to personal information, which the Privacy Policy covers.
06
Links and third-party services
The site links to, and loads resources from, services we do not run. We are not responsible for them, and their own terms and privacy policies apply to your use of them. The Privacy Policy lists the services the site loads.
07
Fraud and impersonation
We ask for payment only under a written contract and invoice. Our email comes from ticktechtoe.in addresses. If someone uses our name to ask you for money, fees, deposits, passwords or codes, or offers jobs or work for a fee, treat it as fraud, do not pay, and tell us at [email protected]. We are not responsible for what an impersonator does.
08
Availability and changes
We aim to keep the site running but do not promise it will be available without interruption or free of errors. We may change, suspend or remove any part of it at any time, without notice.
09
Disclaimer
To the fullest extent the law allows, the site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose and non-infringement. Nothing in these terms excludes anything that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
10
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profit, revenue, data or goodwill, arising from your use of, or inability to use, the site, and our total liability arising from your use of the site is limited to the extent the law permits.
11
Your responsibility
You will make good the loss, damage and reasonable costs we suffer from your breach of these terms or your unlawful use of the site.
12
Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
13
Governing law and disputes
These terms are governed by the laws of India. If a dispute arises, please first write to [email protected] describing it, and give us 30 days to try to resolve it in good faith.
If it is not resolved, it is to be settled by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by agreement or, failing agreement, as the Act provides. The seat and venue of arbitration is Udaipur, Rajasthan, and the language is English. The courts at Udaipur, Rajasthan have exclusive jurisdiction over any matter arising from these terms or your use of the site, including matters in aid of arbitration and the enforcement of any award.
Nothing in this clause limits a right that the law does not allow to be limited.
14
Changes to these terms
We may update these terms. The new version applies from the date shown as “Last updated on” at the top of this page, and using the site after that means you accept it.
15
General
These terms and the Privacy Policy are the whole agreement between you and us about the site. If a part is found unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms; we may transfer ours. You agree that we may contact you electronically, and that emails and notices on the site count as written notice.
